1. Platform
1.1. Our platform is designed to facilitate the booking of driving lessons between learners and instructors. The platform includes a search function that allows learners to find and book lessons based on instructor availability and other criteria.
1.2. CarLer reserves the right to modify, update, or terminate our platform at any time, without prior notice.
1.3. The purpose of CarLer is to connect learners with authorized driving instructors. CarLer does not guarantee the quality of instruction or learner outcomes.
2. Use of Platform
2.1. In order to use our platform, you must create an account. You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account.
2.2. You must be at least 17 years old to use our platform.
2.3. You agree to provide accurate and up-to-date information during the registration process and to promptly update any changes to your account information.
2.4. Unauthorized use of an account or any other security breach must be reported to CarLer immediately.
3. User Content
3.1. Our platform may allow you to post, upload, or submit content, including reviews, ratings, and feedback. You retain all rights to your content, but grant CarLer a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your content in any media.
3.2. You agree that you will not post, upload, or submit any content that is unlawful, defamatory, obscene, or otherwise objectionable.
3.3. CarLer reserves the right to moderate, remove, or edit any user content that violates these terms and conditions or community guidelines.
4. Payments & Booking
4.1. Learners can book lessons with instructors through our platform, subject to the availability of the instructor.
4.2. Learners must pay for lessons through our platform. CarLer will collect payment on behalf of the instructor and remit payment to the instructor after deducting our service fee.
4.3. Cancellations or rescheduling of lessons may be subject to fees or penalties, as determined by the instructor or CarLer.
5. Instructor Requirements
5.1. Instructors must meet certain requirements to be listed on our platform, including possessing a valid driving instructor license, providing proof of adequate insurance coverage, and undergoing a background check.
5.2. CarLer reserves the right to suspend or terminate an instructor's account at any time, for any reason, including failure to meet the requirements or if they engage in conduct that is detrimental to learners or the CarLer community.
6. Limitation of Liability
6.1. Our platform is provided on an "as is" basis, and CarLer makes no warranties, express or implied, regarding the platform or its contents.
6.2. CarLer shall not be liable for any damages, including without limitation direct, indirect, incidental, special, consequential, or punitive damages, arising out of or in connection with the use of our platform.
6.3. CarLer does not assume responsibility for the actions or conduct of instructors or learners during lessons.
7. Governing Law and Jurisdiction
7.1. These terms and conditions are governed by the laws of [Insert governing jurisdiction].
7.2. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of [Insert governing jurisdiction].
7.3. CarLer makes no representation that the platform is appropriate or available for use in other jurisdictions.
8. Amendments & Termination
8.1. CarLer reserves the right to modify these terms and conditions at any time, and will provide users with at least 15 days' notice of significant changes. Users who do not accept the modified terms and conditions will have the right to terminate their contract with CarLer.
8.2. In the event that CarLer wishes to terminate the contract with an instructor, CarLer will provide the instructor with at least 30 days' notice, along with the reasons for termination.
8.3. In the event of a dispute between a user and CarLer, both parties agree to attempt mediation or alternative dispute resolution methods before initiating legal proceedings.
